Purchase rules
- General Provisions
1.1. These Terms and Conditions of Purchase (hereinafter – Terms) are a legally binding document that establishes the mutual rights, obligations, and responsibilities of the person purchasing goods (hereinafter – Buyer) using the electronic store www.groziokodas.lt (hereinafter – E-shop) owned by UAB "AKESUS" (hereinafter – Seller), and the Seller when the Buyer purchases goods in the E-shop (hereinafter – Goods).
1.2. By placing an order with the Seller, the Buyer must familiarize themselves with these Terms and confirms having done so when providing the necessary data for the conclusion of the purchase and sale agreement and for the delivery of the order.
- Conclusion of the Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer forms an order in the E-shop, provides the data necessary for the conclusion of the purchase and sale agreement and for the delivery of the order, and clicks the "Order" link.
2.2. All purchase and sale agreements concluded with Buyers are stored in the E-shop.
2.3. The place of conclusion of the purchase and sale agreement is considered to be the Republic of Lithuania.
2.4. The assortment, quantity, price, and other conditions of the Goods specified in the Buyer’s order become a mandatory and inseparable part of the purchase and sale agreement from the moment the confirmation of the order acceptance is sent to the Buyer at the e-mail address provided by them.
- Price of Goods
3.1. The Seller has the right to change the prices of the Goods sold in the E-shop at any time.
3.2. Prices in the E-shop are indicated including VAT.
3.3. The price of the Goods does not include delivery costs; these are calculated at the time of ordering and added to the final price of the order.
3.4. The price of the Goods that the Buyer undertakes to pay to the Seller is the price indicated in the Buyer's shopping cart at the time of placing the order.
3.5. Ownership of the Goods transfers to the Buyer from the day of full payment for them.
- Buyer's payment methods
4.1. Payment for the Goods purchased in the E-shop is possible using the following optional (alternative) methods:
4.1.1. Using electronic banking services of Swedbank, SEB, Luminor, Citadele, and Šiaulių bankas. Payments are possible in the Euro currency. Payments are processed using the MakeCommerce.lt payment platform;
4.1.2. Using a bank card. The Buyer enters their bank card details, which are processed by the "Stripe" system, which securely confirms the payment;
4.1.3. Using the Seller's gift vouchers.
4.2. An unpaid or unconfirmed order is removed from the E-shop system after 1 day.
- Data on the Goods and their shelf life
5.1. Data on the Goods sold in the E-shop are indicated in the description of the Goods provided next to each Product.
5.2. The Seller is not responsible for the fact that the Goods in the E-shop may not correspond to the real size, shape, or color of the goods due to the characteristics of the display (device) used by the Buyer.
5.3. The specific shelf life of the Goods, if applicable, is indicated on the product packaging.
5.4. If the shelf life of the Goods has expired at the time of delivery to the Buyer, the Seller undertakes to take back such Goods and replace them with analogous, suitable Goods, or to return the money paid by the Buyer for the expired Goods.
- Rights and obligations of the Buyer
6.1. The Buyer has the right to purchase goods in the E-shop in accordance with these Terms and other information sections provided (published) in this E-shop.
6.2. The Buyer undertakes to accept the ordered Goods and pay the agreed price for them.
6.3. In case of discrepancies regarding the received Goods or if other questions arise, the Buyer undertakes to inform the Seller immediately by e-mail: sales@akesus.eu or by calling +37062868364.
6.4. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
6.5. The Buyer undertakes not to transfer their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller by e-mail: sales@akesus.eu or by calling +37062868364.
6.6. When purchasing goods, the Buyer understands that the shade of the Goods/packaging may differ from the shade displayed in the image.
6.7. By confirming the order, the Buyer confirms that all information provided in their order is accurate and correct.
6.8. By ordering goods through the E-shop, the Buyer agrees to these Terms and undertakes to comply with them.
6.9. The Buyer has the right to refuse to accept from the Seller only those Goods or their parts that are of poor quality or do not correspond to those specified in the Buyer's order.
6.10. The Buyer undertakes to check the quality of the Goods and their conformity to the order at the time of delivery of the Goods to the Buyer. If the Buyer accepts the Goods without noting any defects on the invoice or other document formalizing the delivery of the Goods, it is considered that the delivered Goods meet the quality requirements usual for such Goods and the Buyer's order.
- Rights and obligations of the Seller
7.1. The Seller undertakes to create all reasonably implementable conditions for the Buyer to properly use the services provided by the E-shop.
7.2. If the Buyer attempts to undermine the stability and security of the E-shop's operation or violates their obligations, the Seller has the right to immediately and without notice limit or suspend the Buyer's ability to use the E-shop or, in exceptional cases, cancel the Buyer's registration.
7.3. The Seller undertakes to respect the Buyer's right to privacy regarding the personal information provided in the E-shop registration form and to process it in accordance with legal acts regulating personal data protection.
7.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer and in accordance with the Goods delivery rules.
- Responsibility of the Buyer and the Seller
8.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences resulting therefrom and acquires the right to claim compensation for direct losses incurred from the Buyer.
8.2. The Buyer is responsible for actions performed using this E-shop.
8.3. A registered Buyer is responsible for transferring their login details to third parties. If a third party uses the services of the E-shop by logging in with the Buyer's login details, the Seller considers this person to be the Buyer.
8.4. If the E-shop contains links to the websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities contained therein; the Seller does not supervise or control those websites.
8.5. In the event of damage, the Seller and the Buyer shall compensate each other only for direct losses caused by their culpable actions (e.g., the Seller compensates the Buyer for direct losses caused by the Seller's culpable actions). The amount of losses that the Seller must compensate is limited to the price of the Goods ordered by the Buyer.
8.6. The Seller is not responsible for disruptions in the E-shop's operation caused by failures in systems, communication networks, or stations belonging to third parties, or for the disruption of services provided by third parties that the E-shop uses.
- Protection of intellectual property
9.1. The names of Goods or legal entities indicated in the E-shop may be trademarks, and in such a case, intellectual property in them is protected in accordance with the procedure established by legal acts.
9.2. The content of the E-shop is the property of the Seller or its suppliers and is protected by law. Copying or using the information or any part thereof contained in the E-shop without the written consent of the Seller is prohibited.
- 10. Personal data protection
10.1. The Seller undertakes to manage and process the Buyers' personal data in strict compliance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation of the European Union, and the requirements of other legal acts.
10.2. By placing an order with the Seller, the Buyer expresses consent to the processing of their personal data.
10.3. By ordering the Goods and providing their personal data to the Seller, the Buyer agrees to the provisions of the Seller's privacy policy, except for personal data processing actions that require separate consent from the Buyer. - 11. Final Provisions
11.1. The Seller reserves the right to change, edit, supplement, or otherwise modify the Terms and related or other derivative documents and/or rules at its sole discretion at any time. The latest version of the Terms is valid from the day of its publication in the E-shop. The relationship between the Buyer and the Seller is governed by the Terms in effect at the time the order was placed.
11.2. The relationship between the Buyer and the Seller arising from the purchase of Goods in the E-shop and the interpretation of the Terms are governed by the law of the Republic of Lithuania.
11.3. All disagreements arising between the Buyer and the Seller shall be settled through negotiations, and if they cannot be resolved, they shall be settled in the courts of the Republic of Lithuania.
11.4. The Buyer may submit requests or complaints regarding the Goods purchased in the Seller's E-shop via the electronic consumer dispute resolution platform http://ec.europa.eu/odr/.
11.5. Consumer disputes are settled out-of-court by the State Consumer Rights Protection Authority, headquarters address Vilniaus g. 25, LT-01402 Vilnius, https://vvtat.lt/.
